Criminal Sentencing Range There are 3 basic types of criminal offenses: Traffic Misdemeanor Felony Most Traffic tickets, like speeding or failure to reduce speed to avoid an accident are fine only offenses which means that the maximum penalty is only a fine and no possibility of jail.  There are a few traffic offenses, such as Overweight Trucking and Scott's Law Offenses, in which the fine can be up to $10,000.  Any plea of guilty in a case involving an accident may be used against you in Civil court.  A conviction may also cause an increase in your insurance premiums. There are 3 types of Misdemeanors.  The most serious Misdemeanor offense is a Class A Misdemeanor.  It is punishable by up to a year in jail and a $2500 fine.  A Class B Misdemeanor is punishable by up to 6 months in jail and up to a $1500 fine.  A Class C Misdemeanor is punishable by up to 30 days in jail and up to a $1500 fine.  There are also several additional conditions which can be placed on the Defendant by the Court such as alcohol or drug counseling. There are 7 types of Felony cases.  The most severe is Murder which is punishable by the death penalty.  Habitual Criminal is punishable by life in prison without the possibility of parole.  Class X Felony is punishable by 6-30 years in jail and a $25,000 fine.  Class 1 is punishable by 4-15 years and a $25,000 fine.  Class 2 is punishable by 3-7 years and a $25,000 fine.  Class 3 is punishable by 2-5 years and a $25,000 fine.  Class 4 is punishable by 1-3 years and a $25,000 fine.   Extended term may also apply depending on an individual's prior criminal history.  Extended term means that the maximum becomes the minimum jail term and the new maximum is double the old maximum.   There are also several additional conditions which can be placed on the Defendant by the Court such as alcohol or drug counseling.     Probation may also be an option in some felony cases.  You need a lawyer who will fight for you to get the best possible outcome of your case.
