DCFS Appeals

Any time the Department of Children and Family Services (DCFS) gets involved in your life, it can be a very stressful time. DCFS has the power to pull your children out of your house if they deem the danger to
them is great. DCFS can also get the State's Attorney involved and bring your case to Court.  You do not need to deal with them alone.  You have
rights.

DCFS, in how it is set up, is meant to serve a very crucial purpose, to protect the well being of children who cannot protect themselves.There are absolutely cases in which what DCFS jumps in and they save a life. They typically work off tips which may be confidential.  Some of
the tips are valid, however sometimes they are not. DCFS sometimes has
a hard time determining which cases to just let go.

Once a DCFS case begins, they will question everyone involved in
the case. You absolutely have a right to have an attorney present for this
or any interview. Much like the police, the DCFS investigator will try to
dissuade you from getting an attorney by telling you that you have
nothing to worry about. They may tell you that bringing in an attorney
will only cause the case to drag out.  Do not let them change your mind.  
This is not only for the protection of your child, but your rights with the
child.

If a DCFS case comes back as 'INDICATED', then further action
will be taken. That further action can be parenting cases to the removing
of the child of the home. They may attempt to terminate your parental
rights. You need help on your side. The longer you wait, the harder the
case can be to overcome.
